1. Acceptance of Terms
By accessing or using Lead-Mail (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service. These terms apply to all visitors, users, and customers.
2. Use License & Data Usage
Upon purchasing a database from Lead-Mail, you are granted a non-exclusive, non-transferable license to use the data for your own lawful business-to-business (B2B) marketing purposes. This includes:
- Email marketing campaigns (subject to anti-spam laws)
- Direct mail campaigns
- Telemarketing (where legally permitted)
- Market research and analysis
- CRM enrichment and lead generation
Lead-Mail provides data for lawful B2B marketing purposes only. The buyer assumes full and sole responsibility for compliance with all applicable laws including but not limited to CAN-SPAM Act, GDPR, CCPA, CASL, and all local data protection regulations. Lead-Mail shall not be held liable for any misuse of purchased data by the buyer.
3. Prohibited Uses
You may NOT use our data for:
- Sending unsolicited spam or bulk emails without proper opt-out mechanisms
- Any illegal, fraudulent, or malicious activities
- Reselling, redistributing, or sublicensing the data to third parties without written permission
- Harassment, threats, or any form of abuse towards data subjects
- Identity theft, phishing, or social engineering attacks
- Any activity that violates applicable data protection laws
4. Data Accuracy Disclaimer
Lead-Mail strives to maintain the highest data quality standards. We target a 95% accuracy rate for email deliverability. However, business data is inherently dynamic — people change jobs, companies merge, and email addresses become invalid over time.
Data is provided "as-is" without warranty of any kind, express or implied. While we make every effort to ensure accuracy, we cannot guarantee that 100% of records will be current or deliverable at the time of purchase.
5. Refund Policy
We offer a 7-day money-back guarantee under the following conditions:
- The email bounce rate exceeds 10% (verified by industry-standard email validation tools)
- The data materially differs from the product description
- Refund requests must be submitted within 7 days of purchase via our support ticket system
- Refunds are processed to the original payment method within 5-10 business days
Refunds are NOT available for: change of mind, already-used data, free products, or requests made after the 7-day window.
6. Limitation of Liability
In no event shall Lead-Mail, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with the use of our data or services, regardless of whether such damages were foreseeable.
Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Lead-Mail and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your use or misuse of purchased data
- Your violation of these Terms of Service
- Your violation of any applicable law or regulation
- Any claim by a third party arising from your use of our data
8. Intellectual Property
All content on the Lead-Mail website, including design, text, logos, and software, is the property of Lead-Mail and is protected by intellectual property laws. The compiled databases are our proprietary work product.
9. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. Lead-Mail is not liable for any losses arising from unauthorized account use.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration.
11. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will make reasonable efforts to notify users of material changes.
